Argentine Senate (Senado de la Nación Argentina)

The Argentine Senate is the upper house of Argentina’s National Congress. It plays a major role in legislation, representation of provinces, oversight, and some specific powers defined by the constitution.


Composition & Membership

  • Total Senators: 72 members.
  • Representation: Each of the 23 provinces plus the Autonomous City of Buenos Aires elects three senators.
  • Term Length: Senators serve 6-year terms.
  • Renewal: One-third of the seats (i.e. 24 senators) are renewed every two years.
  • Eligibility: Senators must be at least 30 years old; must be Argentine citizens for a certain period; must have residency in (or be native of) the province they represent.

Electoral System

  • Senators are directly elected by the people of each province/district.
  • In each province/district, the party receiving the most votes wins two senate seats; the second-highest vote-getting party gets the third seat.

Leadership & Internal Organization

  • The Vice President of Argentina is ex officio President of the Senate, with a casting vote in case of a tie.
  • There is also a Provisional President of the Senate, elected by the Senate, who presides when the Vice President is absent.
  • The Senate has minority/majority leadership, party blocs, etc., which reflect the party makeup in the chamber.

Powers & Functions

Some of the Senate’s major roles include:

  • Reviewing, amending, approving or rejecting bills passed by the lower house (the Chamber of Deputies).
  • Some bills may be first introduced in the Senate, but in all cases, approval by both houses is required before submission to the President.
  • Participation in matters relating to treaties, international agreements, appointments of certain key public officials (e.g. ambassadors, judges, etc.).
  • It must get a quorum (absolute majority) to deliberate.

Recent Activity & Political Context

  • The Senate has been central to voting on major reforms by President Javier Milei, including sweeping economic reform / “omnibus” bills. These have been controversial and highly contested.
  • In many recent votes, outcomes were very tight (sometimes tied), with the Vice President casting tie-breaking votes.
  • The Senate has also been involved in overriding vetoes by the president, e.g., on disability benefits.

Strengths, Challenges & Significance

Strengths:

  • Ensures federal representation: each province has equal representation (3 senators), which balances the power of more populous provinces in the lower house.
  • Acts as a check on both the lower house and the executive branch. The need for Senate approval (including treaty/appointments etc.) provides oversight.

  • Political polarisation: with different parties controlling different parts of government, debates can become deadlocked.
